Trip Contract

The following terms and conditions are applicable to this trip, to Director’s running of the trip, and bind both Participant and Beyond The Classroom Tour and Travel, LLC.

 

  1. Responsibility: Beyond The Classroom Tour and Travel, its employees, affiliates, directors, and agents, does not own, operate or control any person or entity which is to or does provide goods or services for your trip including, for example, lodging facilities, airline, vessel or other transportation companies, guides or guide services, local ground operators, entertainment or sightseeing operators, providers or organizers of optional excursions, food service providers, etc. All such persons and entities are independent contractors. As a result, Beyond The Classroom Tour and Travel, LLC is not liable for any negligent or willful act or failure to act of any such person or entity, or of any third

Without limitation, Beyond The Classroom Tour and Travel, LLC is not responsible for any injury, loss, or damage to person or property, death, delay, or inconvenience in connection with the provision of any goods or services whether occasioned by or resulting from, but not limited to, acts of force majeure, war, civil unrest, insurrection, strikes or other labor activities, criminal or terrorist activities of any kind or the threat thereof, lost or stolen belongings, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely, dangers associated with animals, sanitation problems, food poisoning, lack of or quality of medical care, illness or disease, difficulty in evacuation in case of a medical or other emergency, actual, perceived or threatened epidemics, or for any cause beyond the direct control of Beyond The Classroom Tour and Travel, LLC.

Changes or substitutions in hotels, itinerary, inclusions, or airports may be made depending on your travel dates, arrival and departure times, national holidays, and events beyond Beyond The Classroom Tour and Travel, LLC control at the sole discretion of Beyond The Classroom Tour and Travel, LLC as it deems necessary or desirable. On certain dates some attractions or activities may be closed. Beyond The Classroom Tour and Travel, LLC at its sole discretion may cancel a program due to insufficient enrollment, unforeseen operational difficulties, lack of projected availability, or any other reason at any time. If a trip is cancelled by Beyond The Classroom Tour and Travel, LLC the sole obligation of Beyond The Classroom Tour and Travel, LLC is to refund all funds collected from any registrant.

Beyond The Classroom Tour and Travel, LLC reserves the right to make audio and visual records of any of its trips and participant agrees that Beyond The Classroom Tour and Travel, LLC may use any such records for promotional and/or commercial purposes, as well as approves of such uses by third parties whom Beyond The Classroom Tour and Travel, LLC may engage without any remuneration to participant. Participant assigns to Beyond The Classroom Tour and Travel, LLC all rights, titles, and interest in or to any and all media related to a Beyond The Classroom Tour and Travel, LLC trip without any remuneration to participant, including photographs provided directly to Beyond The Classroom Tour and Travel, LLC or through websites in which his or her name or likeness may or may not appear. Director assigns to Beyond The Classroom Tour and Travel, LLC all rights, title, and interest in or to any and all media in which his or her name or likeness might be used.

Beyond The Classroom Tour and Travel, LLC reserves the right to decline to accept or retain any person as a member of any trip. In the event a member is expelled from a trip, no refund of any kind will be made. Beyond The Classroom Tour and Travel, LLC reserves the right to cancel any trip with its sole obligation to refund all monies minus fees. These terms and conditions can be changed only by a writing signed by an officer of Beyond The Classroom Tour and Travel, LLC.

Participants understand that they are solely responsible for their pre-program, program, and post-program medical care in all respects, including, but not limited to, obtaining and taking necessary medication(s), vaccinations and any other medical care and treatment.

  1. Any dispute concerning this contract, the Terms & Conditions and/or rules and regulations concerning the trip, the literature concerning the trip and/or the trip itself, shall be resolved solely and exclusively by binding arbitration in Columbus, Ohio pursuant to the then existent commercial rules of the American Arbitration Association. In any such arbitration, the substantive (but not procedural) law of the State of Ohio shall apply. In any such arbitration, the arbitrator may, but is not required, to award attorney’s fees to the prevailing party.
  2. Room Assignments: Room assignments shall be made by the Director. No room changes shall be made without approval of the Director. Each participant is expected to participate in all scheduled activities. The Director shall check to see that participants are present for all program
  3. Health and Safety Measures: Beyond The Classroom Tour and Travel, LLC shall have the right, but not the duty, to take whatever action it deems reasonably necessary in regard to the health and safety of any or all participants including, without limitation, obtaining medical treatment on their behalf and transporting them at their own or their parents’ expense to their home for medical or other emergency
  4. Changes and Program Costs: The programs offered by Beyond The Classroom Tour and Travel, LLC have been designed in advance of departure. Beyond The Classroom Tour and Travel, LLC shall have the unqualified right to alter, amend, or cancel such programs and to make any adjustment to the program cost prior to departure in order to meet unanticipated contingencies, including any changes in transportation costs, government taxes and fees, airline increases, fuel surcharges, program costs, international exchange rates (if applicable), or lack of participation in the program. It is understood that any additions or alterations may increase the cost of the program. Participation in the program constitutes a conclusive approval of the itinerary and program
  5. Insurance: All participants are provided accident, illness and accident related dental insurances coverage up to $7,000 for accident, $1,500 for illness, and $750 for accident-related dental. Pre-existing· conditions are not Any charges not covered are the responsibility of the participant.
  6. Late Registration Fee: Groups that have not completed their registration within 60 days or less from departure date will be subject to a $10.00 per person late registration fee. Registration is considered complete when Beyond The Classroom Tour and Travel, LLC receives the (initial deposit including the $100 non refundable deposit)
  7. Payment Schedule and Late Fees: Beyond The Classroom Tour and Travel, LLC will set forth the payment schedule established by Beyond The Classroom Tour and Travel, LLC in the Proposal and Invoice. Payment not made by the established due dates are subject to a 2% late fee on the outstanding installment
  • Independent Contractor: Director is an independent contractor and is not an employee of Beyond The Classroom Tour and Travel, LLC.
  1. Professional Manner: Director agrees to perform his or her duties in a professional
  2. Name Changes: Beyond The Classroom Tour and Travel, LLC will assess a $100 fee to any individuals who require a name change on his/her airline ticket. Any request for a name change within 60 days of departure may be denied by the air carrier and will be subject to additional fees.
  3. Travel Documentation: Every participant must have the required documentation necessary to participate in the trip prior to the date of departure, including needed identification that fully matches the name provided to Beyond The Classroom Tour and Travel, LLC for inclusion on travel documentation and airline tickets, and must meet any other applicable compliance requirements issued by the Transportation Security Administration or related Beyond The Classroom Tour and Travel, LLC provides online and customer service means for keeping the program participant’s information current and it is the participant’s sole responsibility to assure that this information is fully up to date no later than 60 days prior to the group’s departure date. If changes occur after that date, the participant must contact his/ her Director and additional change fees might apply. In the case of international travel, including travel in the Americas, the participant is additionally and solely responsible for obtaining a passport or visa in order to travel. Passports must be valid for at least six months after your return date. It is the responsibility of the participant to check and fully comply with the requirements for travel between the United States and the countries that you will be traveling to or through. If a participant is unable to travel due to the lack of a proper identification, passport or visa, or necessary inoculations, the standard cancellation policy will apply.

  1. Behavior Code and Rules and Regulations: The Beyond The Classroom Tour and Travel, LLC tour you have elected to attend offers many unique opportunities and experiences. In order to gain maximum benefit for my participant from those experiences in an environment of safety and respect, I have reviewed the Behavior Code and Rules and Regulations and understand that the code and these rules establish a minimum set of requirements which may be added to before and/or during the tour by Beyond The Classroom Tour and Travel, LLC or the Director. I agree that these requirements are suitable for the participant I am registering, that I will review them with the participant, and that I will assure their thorough understanding of them and agreement to abide by them prior to

We at Beyond The Classroom Tour and Travel, LLC promote a tour atmosphere where chaperones and students support one another with genuine respect. As a student participant, it is your responsibility to help make the tour a positive and enjoyable experience for yourself, fellow students, director, and chaperones. All participants are expected to demonstrate high standards of conduct and to accept personal responsibility and consequences for their actions. You are expected to exhibit honesty, courtesy and consideration toward others. This includes those in your group, as well as anyone else with whom you may come in contact, such as bus drivers, guides, restaurant and hotel staff and other guests at venues where you will be visiting or staying.

We require your cooperation and commitment to the following behavior standards to help us meet this goal. We expect the student participant to obey the directions, the Behavior Code, the Rules and Regulations and the rules and regulations established by the Director, the chaperones and/or Beyond The Classroom Tour and Travel, LLC both prior to and during the trip. All program participants will be responsible for their own actions at all times and Directors and chaperones are responsible for the actions of all participants in their group.

The rules for the program include a zero tolerance for the following, which constitute grounds for· immediate expulsion:

Alcohol and Tobacco – No use of tobacco or non-prescription drugs is allowed. No consumption of alcoholic beverages is allowed.

Drugs -International laws and penalties with regard to the possession and usage of narcotics are more severe than those in the United States. Whether a juvenile or adult, you may be out of the U.S. government jurisdiction. All drug use is strictly prohibited.

Arrests -Beyond The Classroom Tour and Travel, LLC participants arrested by authorities are not the responsibility of Beyond The Classroom Tour and Travel, LLC. If arrested, the student may be subject to prosecution by local law enforcement authorities and must understand that Beyond The Classroom Tour and Travel, LLC has no obligation to defend him/her in such proceedings. It is the Director’s responsibility to inform parents and guardians of the phone number and address of the appropriate ‘law enforcement agency to contact.

The student shall comply with all rules and regulations of the various governmental agencies and third party vendors such as airlines, hotels, bus companies, etc. The student shall respect and follow the directions of the chaperones, Director and Beyond The Classroom Tour and Travel, LLC staff. The use of hotel facilities carries with it the responsibility of leaving them in the same conditions in which they were found. The student is responsible for any damage.

Quiet hours at the hotel will be observed from 11:00PM until 5:00AM. Curfew at the hotel is 11:00PM. Students must remain in his/her room until the start of the following day’s activities. Students may not leave the group at any time unless specifically authorized to do so by the chaperones or the Director. The student must sleep in his/her assigned hotel room each night.

Good common sense, respect, and consideration for others and their property should be practiced daily. The student is solely responsible for keeping safe possession of his/her passport, as applicable, and other travel tickets and documents. –

If the student or participant should violate any of these rules, he/she may be sent home at the sole discretion of the chaperones, the Director or Beyond The Classroom Tour and Travel, LLC. In such cases, the parent/guardian will be contacted and the student sent home at the parent’s expense with no refund from Beyond The Classroom Tour and Travel, LLC.

 

  1. Cancellation: Beyond The Classroom Tour and Travel, LLC programs which travel by air are generally booked on promotional airfares. These fares have certain restrictions and/or penalties regarding reservations and cancellations. In the event of any cancellation of any reservation after an airline ticket has been issued by the air carrier, the participant shall forfeit the amount of the airline cancellation penalty in addition to the other cancellation penalties listed below. In the event the school or any participant desires to cancel a reservation, all cancellations must be made in writing by or on behalf of the person listed on the registration form through their Director to Beyond The Classroom Tour And Travel 1528 Horton Place Columbus, Ohio 43228, must be postmarked prior to the group’s departure, and must include the participant account number provided at the time of registration, registrant’s name and complete address. Upon such a cancellation, and subject to all other provisions of this paragraph, the participant shall only be entitled to a refund on the following basis and there shall be no other refunds, including for unused services or program features after the group departs:
    1. If the reservation is cancelled by the school, Director or participant, at least ninety (90) days prior to departure, Beyond The Classroom Tour and Travel, LLC will refund all amounts paid less (the $100 non refundable deposit per person), any amounts relating to the group deposit, and all applicable airline, other vendor and other cancellation
    2. If the reservation is cancelled by the school, Director or participant, less than ninety (90) days but more than forty-five (45) days prior to departure, Beyond The Classroom Tour and Travel, LLC will charge a 50% cancellation fee based on program price (including any amounts relating to the group deposit) plus all applicable airline, or vendor and other cancellation fees (including the $100 per person non refundable deposit).
    3. If the school, Director or participant cancels the reservation less than forty-five (45) days prior to departure, no refund will be

In the event that an individual must cancel or a trip is cancelled as a result of or following an act of God, war (whether declared or not), terrorism, civil unrest, or in the event of Beyond The Classroom Tour and Travel, LLC’s bankruptcy, insolvency , or cessation of business no refunds will be given.

  1. Cancellation by a Supplier: (For California residents only) Upon cancellation of the transportation or travel services, where you, the customer, are not at fault and have not canceled in violation of the terms and conditions, if any, of the contract for transportation or travel services, all sums paid to Beyond The Classroom Tour and Travel, LLC for services not received by you will be promptly refunded by Beyond The Classroom Tour and Travel, LLC to you unless you otherwise advise Beyond The Classroom Tour and Travel, LLC in writing. Registration as a seller of travel does not constitute approval by the state of California. Beyond The Classroom Tour and Travel, LLC ‘s principal office is located in Columbus, OH. This transaction is not covered by the California Travel Consumer Restitution Fund. You are not eligible to file a claim against that Fund in the event of Beyond The Classroom Tour and Travel, LLC (For Washington State residents only) If transportation or other services are canceled by Beyond The Classroom Tour and Travel, LLC all sums paid to Beyond The Classroom Tour and Travel, LLC for services not performed in accordance with the contract between Beyond The Classroom Tour and Travel, LLC and the consumer will be refunded within 30 days of receiving funds from the supplier with whom the services were arranged, or if the funds were not sent to the supplier, the funds shall be returned within fourteen days after cancellation by Beyond The Classroom Tour and Travel, LLC to the consumer unless the consumer requests Beyond The Classroom Tour and Travel, LLC apply the money to another travel product and/or date.
